The following conditions apply to the use of CatchPromos services.

Acceptance of Terms of Use

These Terms of Use (“Terms”) govern your use of all the interactive websites, software, mobile and connected applications, and other online interactive features, including but not limited to emails, forums, communities, newsletters, sweepstakes, and contests (together, the “Services”), operated or owned by CatchPromos, Inc. and its subsidiaries (collectively, “CatchPromos,” “we,” “our,” or “us”). By using the Services, you agree to these Terms of Use (defined below), whether or not you become a registered user of our Services. You also agree to our Privacy Policy, incorporated herein by reference, and acknowledge that you will visit our Terms (defined below) repeatedly to keep yourself familiar with any updates.

In case, if you don’t agree to these Terms, please do not use any CatchPromos service.

CATCHPROMOS RESERVES THE RIGHT AT ALL TIMES TO CHANGE, MODIFY, ADD OR DISCONTINUE ANY PORTION(S) OF THESE TERMS, AT ITS SOLE DISCRETION, BY POSTING CHANGES TO THIS PAGE. YOUR CONTINUED USE OR ACCESSING OF THE SERVICES FOLLOWING THE POSTING OF ANY CHANGES CONSTITUTES YOUR ACCEPTANCE TO ALL SUCH CHANGES.

Eligibility

To access and use the Services, you represent that you are a13 years or older individual who can create legally binding contracts. Children under13 years of age are strictly prohibited from using the Services. In case, you are a minor in your jurisdiction of residence, the consent or supervision by a legal guardian is mandatory to enter the Terms of Use, and use the Services. Moreover, if we have previously suspended or deactivated your user account, and/or suspended you from the Services, you are not allowed to use our Services.

Registration

To use or access a certain portion of our Services, you may be asked to complete a registration process and set up an account with CatchPromos (“Account”), and agree to provide the accurate, current, and complete information. You further represent that you will maintain and update your information to keep it accurate and complete. You also acknowledge that if any portion of the information provided by you is not current, incomplete, or inaccurate, we reserve the right to dismiss your use and access to the Services. Furthermore, our Privacy Policy governs the use and disclosure of any kinds of information provided by you.

Username and Password

As part of setting up your account and complete the registration, you may receive or select a username and one or more passwords. You will be solely responsible for the confidentiality, security, and use of your password(s) and Account(s). You understand and warrant that you will be entirely responsible for all the postings and other activities made from your Account(s). You agree to notify CatchPromos promptly if you came to know any unauthorized use of your Account(s).

Your Privacy

CatchPromos takes the privacy of our users seriously. We encourage you to review our Privacy Policy carefully, to understand the collection, use, and sharing of personal information and your choices. Our Privacy Policy (available here) is incorporated herein by reference and is subject to these Terms of Use.

Ownership of Content

Except for User Content(defined below), all the coupons, promo codes, offers, text, images, logos, advertisements, graphics, documents, press releases, audio, video, and other content information available on or through our Services (the “Content”), is the property of CatchPromos or its licensors. You must understand that the Content is protected and secured by copyright, trademark, and other intellectual property laws. Furthermore, you recognize and agree that we hold all right, title, and interest in and/or to the Content.

License to CatchPromos

When you post or contribute content to our Services, or provide any feedback, ideas, suggestions, and other submissions to CatchPromos, you grant CatchPromos a perpetual, royalty-free, non-exclusive, and worldwide license to use your content in regards to the operation of the Services. CatchPromos has (a) the license rights to publicly display, publicly perform, distribute, transmit, edit, reproduce, reformat, and translate your content, and/or combine it into a collective work, and (b) entitlement to sublicense any or all of CatchPromos’ license rights to others. For greater certainty, CatchPromos has the right to use any of the content you submit in any matter that we choose without any obligation to you whatsoever.

User Content

CatchPromos does not pre-screen all contributed content by users such as comments, reviews, ratings, opinions, photos, and other material (“User Content”). However, CatchPromos retains the absolute right to delete or remove any content posted, without any notice. You accept that you may see offensive, inaccurate, indecent, or objectionable User Content on the Services; and you agree to, and at this moment do, refrain from any legal or equitable rights, claims, or remedies you may have against CatchPromos relating to or arising from User Content.

By posting any content, you represent and warrant that such posted content and your public account profile is in the public domain. When you register with us via third party accounts such as Google and Facebook, your CatchPromos profile may link to your associated public profile on that account as well. For this reason, you should post the content you are comfortable sharing or disclosing under these terms and conditions (“Terms”).

You also agree not to post any of the following types of User Content (each, a “Prohibited Content”):

• Adult and sexually explicit content, nude images, pornography
• False, fraudulent, misleading, or deceptive content
• Content that is obscene, hateful, abusive, and defamatory
• Content that violates and/or encourages violations of laws or regulations, and promotes illegal activities
• Content that violates a third party’s copyrights, trademarks, trade secrets, publicity rights, privacy rights, or other intellectual or proprietary rights
• Content that is or intended for phishing, scams, or spreading malware
• Content that impersonates or is disparaging of any other person or entity
• Content promoting pirated software
• OR any other content that is considered offensive, inappropriate, or unsuitable, all as determined by us

Unsolicited ideas

CatchPromos does not accept or consider any unsolicited ideas, including, but not limited to ideas for advertising, promotions, marketing plans, processes, technologies, or new products. Therefore, please DO NOT send us any such unsolicited ideas, suggestions, images, or other material in any form (collectively, “Unsolicited Materials”). CatchPromos has no obligation to review any such unsolicited ideas, nor to treat them as confidential or proprietary.

Member Disputes

CatchPromos reserves the right, but has no obligation, to monitor member disputes and to take action such as account deletion or removal of content posted by a user. You acknowledge that you are entirely responsible for your interactions with other members of the Services. However, if you have other concerns regarding your use of the Services, please contact us.

Indemnities

You acknowledge and agree to defend, indemnify, and hold CatchPromos, its officers, affiliates, agents, employees, and directors, harmless from any and all claims or demands made by third parties, proceedings, liabilities, costs, expenses, and damages arising out of or relating to your use of the Services.

Termination

CatchPromos reserves the right, in its sole discretion, to change, restrict, discontinue, or suspend your access or use of the Services or any portion thereof, at any time without prior notice or liability. CatchPromos also reserves the right at all times to modify, suspend or discontinue all or any aspect of the Services without any notice or liability to you.

Dealings with Advertisers

Your participation in promotions of, or any business dealings and correspondence with advertisers via the Services, including, payment and delivery of goods and/or services, any terms, and conditions, or representations related to such dealings, are entirely between you and such advertiser. You expressly agree and warrant that CatchPromos will not be responsible for any loss or damage incurred due to such dealings, or due to the presence of such advertisers on our Services.

Limitation of Liability

In no event shall CatchPromos and its licensors be liable for any damages or any kind arising from your use of, or access to the Services, including but not limited to direct, indirect, consequential, punitive, special, and incidental damages.

Disclaimer

CatchPromos provides the Services on an “As Is” and “As Available” basis, with no warranties whatsoever. CatchPromos, its affiliates, subsidiaries, licensors, merchants, third party content providers, directors, employees, or any of their officers or agents disclaim to the fullest, any kind of warranties, express or implied, to the operation of the Services, or the products, materials, content, or information available on or through the Services. All content, including without limitation, any offer or coupon, advice, opinion, email, recommendation, or information about any product, retailer, service, drug, recipe, and health provided via the Services is only for information purposes, and should not be understood that CatchPromos endorses any such content. CatchPromos makes no representation that the Content is reliable, timely, accurate, virus free, effective, or safe for use. You expressly agree and warrant that your use of the Services is at your sole risk. Moreover, you also agree not to use our Services in violation of any regulation, rule, or applicable law, or any third party right.
